Their own lawyers warned them, separately, that having a baby together after the split could carry legal “consequences.” They read the warning, signed off on it, and decided to try anyway.
Jelly Roll and Bunnie Xo were each told by their own attorneys not to have children together as a divorced couple, according to the marital dissolution agreement obtained by PEOPLE.
The lawyers flagged possible “consequences” to a baby together “due to evolving technology and case law; as well as the ‘interim category’ of interest afforded to said genetic materials.” Both sides also conceded their attorneys aren’t experts “with regard to genetic and reproductive rights,” and were “directed and advised” to consult a qualified expert outside their legal teams. Court filings say the pair “specifically chosen not to seek such counsel.”

The couple, who don’t share any children and had planned to welcome one via surrogate, finalized the divorce weeks before what would have been their 10th wedding anniversary. Jelly Roll, whose real name is Jason DeFord, filed on May 18 citing irreconcilable differences, with a separation date of May 9. They married in Las Vegas in August 2016.

He’s already a father to daughter Bailee Ann and son Noah Buddy from previous relationships.

Bunnie Xo, whose real name is Alisa DeFord, said the two still hope to raise a child together on the June 18 episode of her Dumb Blonde podcast. “So, we have been the most unconventional couple that you guys have ever encountered,” she said. “We’re going to co-parent together. J is my best friend. Like, this isn’t what you guys think this is. Nobody cheated on the other person. It’s literally just we served our purpose for each other.”

She’d already written about the plan, and named a surrogate, in her memoir Stripped Down, published in February.
